Dutch Tax Law: IB, Vpb, BTW & Box-Systeem

Dutch income tax is governed by the Wet inkomstenbelasting 2001 (IB 2001), which uses a three-box system. Corporate tax by the Wet op de vennootschapsbelasting 1969 (Vpb). VAT by the Wet op de omzetbelasting 1968, aligned with EU VAT Directive. The tax authority is the Belastingdienst. Annual income tax return (aangifte IB) deadline: 1 May for the preceding year (extension to 1 September with DigiD authorisation).

Box 3 has been subject to ongoing litigation following the Kerstarrest (Christmas ruling, HR 24 December 2021): the Supreme Court ruled the notional return system in 2017-2022 violated the European Convention on Human Rights if it exceeded actual returns. Belastingdienst now uses a hybrid calculation (rechtsherstel) based on actual returns for 2017-2022. A new Box 3 system based on actual returns is planned for 2027.
