Stefan, a software engineer earning EUR 5,800/month gross with 8 years of service, was dismissed (Kuendigung) by his Vienna-based employer. Required notice: 3 months to end of quarter. The employer failed to give proper notice and paid in lieu. Stefan challenged the dismissal as sozialwidrig (socially unjustified) before the ASG Wien (ArbVG 105). After mediation through the Arbeiterkammer, Stefan received a settlement of EUR 29,000 (5 months salary equivalent) plus continued MVK contributions during the notice period. BMSVG balance accumulated over 8 years: approximately EUR 5,100.
